Las Vegas (February 7, 2006) - In an expected and sweeping victory for carriers, employers and pharmacy benefit managers, Working Rx’s claims against ScripNet were dismissed by a Federal District Court on Monday, February 6.
Working Rx, a collections company specializing in pharmacy receivables filed suit against ScripNet on October 12, 2005. In the complaint, Working Rx claimed that it was underpaid for pharmaceuticals dispensed by pharmacies that had assigned payment rights to Working Rx. Ruling from the bench, Federal District Court Judge Clive Jones granted ScripNet’s motion to dismiss Working Rx’s causes of action.
Notably, during the hearing, Judge Jones reminded Working Rx’s counsel, and Working Rx’s counsel seemingly agreed that as a pharmacy assignee, Working Rx had no greater rights to compensation from ScripNet than the contracted pharmacy would have.
Judge Jones did grant Working Rx the opportunity to amend its pleadings to state a valid claim, but only if it does so within three weeks. ScripNet continues to seek declaratory relief against Working Rx in Travis County, Texas.
ScripNet is a national Pharmacy Benefit Manager that contracts with workers’ compensation insurance carriers and pharmacies to ease the availability of prescription medications to injured workers.
